In protest of the Constitution day of India which took place on January 26, 1950, a protest has been organized and is being held on Sunday February 01, 2015 from 11:00 AM to 02:00 PM at Pearson Convention centre situated at 2638 Steeles Avenue East Brampton, Ontario, Canada.

It is critical to note, that despite “celebrating” constitution day, and claiming to be the largest democracy in the world, the Indian government is and has for decades illegally occupied many different territories including Maqbooza Kashmir, or Indian occupied Kashmir. Through these illegal occupations, the Indian government has killed hundreds of thousands. In Maqbooza Kashmir alone, over 200,000, and in Punjab (Khalistan) more than 270,000 innocent civilians have been murdered.

As such, we must realize that in order for injustice to persist, all it takes in the silence of the just. Let us not remain silent. Let us raise our voices against oppression under the name of human rights and humanity for those who have no voice of their own as we cannot stand by idly as on one front the Indian government commits atrocities and genocide, and on the other, celebrates its constitution as a so called peaceful “democracy”.

Mailk Jamil Ahmed Farooqi was a very loving person and beloved brother of Engineer Zamiruddine Malik, a founding member of KDA (Canada). May Allah (SWT) forgive him of his shortcomings and bless him with the highest place in paradise. Also, we pray that Allah (SWT) grants the loved ones he has left behind with the patience to bear with this irreparable loss.

Kashmir is a part of Pakistan like any other province in the state. At the time of partition Hyderabad to accede to Pakistan along with Junagar; similarly, the people of the state of Jammu and Kashmir unanimously passed a resolution under the banner of the Muslim Conference on July 19, 1947 to join Pakistan as well. India on the basis that Junagar and Hyderabad have majority Hindu populations should be a part of it and hence moved forward and occupied the two states by force. India did not want to have Kashmir accede to Pakistan as such, it made a false excuse that it is invading Kashmir in order to maintain law and order and is not meant to occupy the land. Decades later, it is yet to withdraw its occupation forces. The people of Kashmir resisted peacefully to no avail. Instead India has killed over 200, 000 people in the occupied territory and there is no single day which atrocities and human rights violations are not committed. It is the responsibility of all peaceful nations in the international sphere a long with the UN that it should enforce the United Nations resolution to have India withdraw its occupation forces from Kashmir. It is also the primary responsibility of Pakistan to liberate Kashmir from Indian occupation as we the Kashmiris are a rightful part of Pakistan.

It is also essential to bring to the fore the demographic changing agenda of the Indian government. After the genocide of the Muslims of Jammu in 1947 wherein over 100,000 innocents were butchered and many more were forced to leave which is inexcusable and appalling; the rapid placement of Hindus in the Internationally Disputed Areas of Jammu Kashmir began. These were primarily refugees who migrated from Pakistan or came from all over India being situated in areas of Kashmir that do not belong to the Indian state. This is a blatant attempt to try and change the demography of the state to turn it into a Muslim minority state and from the outset starting from decades back, this demographic changing continues to take place until today. This agenda has even as gone as far as the ruling BJP party using a scheme called “ghar wapsi” where poor and marginalized Muslims are being given homes and jobs granted they convert to the religion of Hinduism as they feel that they were originally Hindus centuries ago. This is just the tip of the iceberg and attests to the extent that the Indian state will go.

Regardless of whether a territory is a part of its rightful sovereign state, or, if it is occupied by another invader/occupier; the people on the ground always have a standard set of human rights as designated to them as human beings. This is outlined within the auspices of the United Nations. However, if we look at the area of Maqbooza Kashmir, or, Indian occupied Kashmir, there is quite of a bit of a paradox taking place, or rather, irony. On one hand India claims to have rightful ownership of Maqbooza Kashmir and refuses to withdraw its 700,000 occupation forces and military personnel. On the other, the Indian government is treating the people on the ground, who its claims are its citizens worst than those rules set out for peoples that are occupied. Where is the logic in this?

With over 203, 002 citizens murdered by the Indian regime, over 216,194 arrests made, is this how a state treats its “citizens” that it claims to be a government of, or for that matter peoples that you they occupied? With over 110,317 having disappeared in Maqbooza Kashmir and over 115,982 homes having been demolished for both subordination of the local populace and quelling political uprisings; can this even be claimed to be adequate treatment of occupied peoples by any standard, let alone by the international human rights standards of the United Nations? 122,992 widows and 207,535 orphans are the result of this indiscriminate assault on the people of Maqbooza Kashmir. What legitimizes this?

India must hand over the occupied territory of Maqbooza Kashmir to Pakistan as this is its rightful territory. This can be done through plebiscite or referendum with only two options; accession to India or Pakistan. A separate sovereign state has no legitimacy, and quite frankly, is prone to be used as a proxy by the Indian state while keeping the masses subordinated in that situation as well. This is not freedom and cannot be an option.

Pakistan must take hasty action as the situation is becoming grave with the occupied territory of Kashmir, designated by the UN as Internationally Disputed Areas of Jammu Kashmir alias  Maqbooza Kashmir. The Indian government is taking swift and increasingly illegal action by continuing and accelerating its longstanding campaign of changing the demographic situation with the occupied territory of Maqbooza Kashmir. The fact is, the Indian state is well aware that it has no real legitimacy in the international sphere with regards to its claims on the territory that it has occupied for decades now. At the same time, if it takes part in administering a plebiscite or referendum that it, itself pushed for under the auspices of the United Nation; it knows that since Kashmir is the rightful part of Pakistan and a Muslim majority state it will accede to its rightful state.

However, now more than ever, this deterrent to oppression is losing its luster. The reality on the ground is changing and the Indian government’s plan of changing the demographic situation is already well under way. In the recent election in December 23, 2014, out of 87 seats, the Bharitiya Janata Party (BJP) was able to attain 25 seats. This is shocking to say the least and attests to the covert operation of the Indian government coming to the fore. Demographic changes are taking place through various different means. Some of the most prominent methods are that armored personnel/military personal from India after retirement are given property and land within the occupied territories. Also, many individuals that had left West Pakistan are being relocated in the occupied territory.

The conclusion is clear; hasty action must take place on behalf of the Pakistani government or else a day will surely come where the Indian government will be more than willing to administer a plebiscite/referendum and would have the occupied territory accede to them legally, without the use of its occupation forces as its illegal plan for demographic shifting would be successful.

In order to protect the right to religious freedom, the Indian subcontinent was divided on the basis of religion so that wherever the majority Hindu or Muslim population resided, the majority would not oppress the minority. Unfortunately, India in order to establish its hegemony it has occupied Kashmir and Khalistan. It is a well known fact that in India Muslims and Christians are being coerced into conversion as the poor are being converted through providing housing and occupation. Kashmir as per the partition plan is completely apart of Pakistan however it has been occupied since October 27, 1947. Since the first day of occupation, the Indian government is attempting to do whatever it can in its power in order to change the demographic situation in the occupied territory. 

The statement Sikh Guru, Janab Gobind Singh Sahib is already being proved to be true where he said, “without government, religion will not prevail.” At the same time he also states that without religion, the nation will be derailed. As such, it is no surprise that without a state, the Sikh nation is falling apart losing any form of identity that they have that remains. They are being forcefully told that they are Hindu and do not even have a claim over their own identity. Over 270,000 Sikhs have been murdered until today. Not a single day goes by where human rights violations do not take place in these occupied territories. 

Similarly, more than 200,000 Muslims in Kashmir have also been mercilessly killed. There is also that widespread fear that the same situation of the Sikhs, or in the rest of India where all minorities are being forced into the fold of Hinduism, the same situation is developing in Maqbooza Kashmir as well. The Muslim religion is in grave danger in the occupied territory of Maqbooza Kashmir.
