ASSALAM-O-ALAIKUM!

A king asked his two sons that if a foreign invader were to attack our borders, what action would you take? The first child stated that he would gather the entire army and send it out to the border in order to crush the invaders. After this, he asked his second son. The second son stated that he would keep 1/3rd of his forces in reserve, 1/3rd in the domestic sphere, and 1/3rd to go and fight at the border.

We must realize that before we can go after any other territory that is rightfully ours; we must first secure Azad Kashmir. Two chief minister or governor must come to the fore in order to secure Azad Kashmir and provide it with the leadership that it deserves. Once Azad Kashmir is secured, it will be much easier to liberate Maqbooza Kashmir. The land is always for the people, so we cannot take back Hindu majority areas of Jammu and Kashmir as although it is possible for the Pakistan army, the human cost is to high and the sacrifice too great. Out of 42,000 square miles, if India peacefully gives back 30,000 square miles and its 10 million inhabitants of the area which is majority Muslim inhabited; this is sufficient.  At the end of the day though, our immediate goal is to secure Azad Kashmir.

Indian sympathizers claim that since Kashmir is 6000 years old and Pakistan was created in 1947, therefore it cannot be a part of it.  This is a naive argument to say the least. What of the princely states which are now a part of India or of Texas which was once a sovereign state, or New York, which is older than the United States of America but still one of its 50 states. There are thousands examples out there to understand where the cities were established first before and then they became part of a country. Conversely, Raja Farooq Haider Khan former Prime Minister/Chief Minister of Pakistani Azad Kashmir asserts that Azad Kashmir be also given provincial status.  


THE AZAD JAMMU AND KASHMIR INTERIM CONSTITUTION ACT, 1974 (ACT VIII OF 1974), clause 7-2 states;  No person or political party in Azad Jammu and Kashmir shall be permitted to propagate against, or take part in activities prejudicial or detrimental to, the ideology of the State’s accession to Pakistan.


In reality, Azad Kashmir is constitutionally a part of Pakistan. It is time that instead of living in an illusion Azad Kashmir should also be renamed as the sixth province of Pakistan. It is already established in constitution that it is a lawful territory of Pakistan. There is no need to go through all constitutional amendments. A presidential order is more than sufficient. Last but not the least; Pakistan must realize that it is in a ethically superior position to exert its influence, and to demand India to withdraw its forces from Maqbooza Kashmir.

AZAD KASHMIR MUST BE GIVEN PROVINCIAL STATUS AS WELL: HABIB YOUSAFZAI, THE CHAIRMAN KASHMIR DIASPORA ALLIANCE

Gilgit Baltistan was approved as the fifth province by the president of Pakistan through a presidential order. In order to avoid any further delay, Azad Kashmir should also be given provincial status by a presidential order as well. We the inhabitants of Maqbooza Kashmir will join as a seventh province when it is liberated from Indian occupation. There is no need to let them suffer further without an official identity in Azad Kashmir. Further, Azad Kashmir must also be given participation in the decision making process of federal affairs. They must also be entitled to equitable share of wealth of Pakistan as well.

Muslims once ruled India for 1000 years, and despite there being 560 princely states, even these states were also a part of their government. However, it is undeniably that Indian subcontinent is made up of various different faiths, each having the right to govern their respective areas of majority inhabitance. After British colonization ended, this was the basis for the partition plan.

Kashmir was just one of these areas which was almost exclusively inhabited by a Muslim population. After its initially occupation, India claimed to have entered Kashmir to maintain law and order. After decades of occupation, it has maintained its occupation and attempted to legitimize it by now changing its stance that Kashmir is an integral part. This is in direct contradiction with what the Indian state stands for, as essentially, India is Hindustan.  

The citizens of Kashmir have long before given their verdict under Sardar Ibrahim Khan Ghazi-e-Millat a leader of Muslim Conference on July 19, 1947 that the state of Jammu and Kashmir will constitute as part of Pakistan. As stated above, this is logical as more than 95 % of the population were of the Muslim faith.

It is worth noting, that India maintains its illegal occupation despite the fact that its lack of legality is inscribed in international law. After partition, the whole state of Jammu and Kashmir became a legal part of Pakistan as the India before partition no longer exists. There is now only Hindustan, Pakistan, and Bangladesh etc. As such, the state of Jammu and Kashmir is a rightful part of Pakistan.

The people of Azad Kashmir have been liberated, but they need an identity which is established through constitutional law. It is immoral and unjust to keep the inhabitants of Azad Kashmir without this legal status. This is a prerequisite before Pakistan can put out a claim on Maqbooza Kashmir. India’s ultimate goal is to maintain/establish hegemony over the subcontinent. It has merged the Sikh nation forcibly in order to utilize its people for its immoral cause. India will exert all its efforts in trying to make Kashmir an independent state as soon as it feels it is losing control of it which it eventually will. In this scenario, India still stands to gain as Pakistan will be deprived of 12 million of its citizens a separate proxy state is created. It is better to act now to secure Azad Kashmir rather than expressing regrets afterwards. Pakistan must secure Azad Kashmir by adopting constitutional resolution as its sixth province in order to lay legitimate claim to its legal territory of Maqbooza Kashmir.

Last but not the least, Pakistan will be in not only in a ethically superior position to exert its influence and demand India withdraw its forces; but moreover, it will have solidified in its constitution what is already established in international law via the UN Resolution. How much more atrocities have to take place before the Pakistani state pushes forward and recognizes the necessity of this action? The UN department of Human Rights indicates that the Indian regime and its armed forces to date have murdered more than 203,027 citizens, made 216,219 arrests, 110,352 have disappeared, 116,008 homes have been demolished, leaving 123,107 widows and 207,661 orphans. Enough atrocities have been committed! We must act now.
