STRIKE CALL ON first July 2013 to protest against Indian brutalities in Maqbooza Kashmir (Shabir Shah)

Prominent pro-freedom leader and Chairman Democratic Freedom Party Shabir Ahmad Shah, Chairman National Front Nayeem Ahmad Khan, Chairman J.K.L.F (H)Javaid Ahmad Mir, Chairman Muslim Conference Shabir Ahmad Dar, Chairman Islamic Political Party Mohammad Yousuf Naqash and Chairman International Forum for Justice and Human Rights Forum Mohammad Ahsan Untoo in a joint statement strongly condemned the brutal killing of two Kashmiri youth from Tang Mohalla markandal Sonawari, Irfan Ahmad Ganai and Tariq Ahmad Leherwal and injury to five others by Indian army personnel. They expressed deep shock on the gruesome incident and expressed solidarity with the bereaved families and said that killing Kashmiris people is the policy of India to suppress the sentiment of freedom and movement for realizing it.  While strongly refuting  the false and misleading claims of Indian foreign minister Mr. Salmam Khursheed that Kashmir is the internal matter of India, Chairman Islamic Political Party Maqbooza Jammu and Kashmir Mr.Mohammad Yousuf Naqash said that Maqbooza Kashmir is the internationally recognized dispute and Pakistan is its important party and both Pakistan and international community  have the obligation of direct interference and involvement (by virtue of many Kashmir specific resolutions in united nations organization) for the just , honorable and lasting solution of Kashmir, and freedom of Kashmir on the principle of right to self determination enshrined in united nations charter  is the only solution. Mr.Naqash further said that Indian leaders and its local stooges are not the well wishers of Kashmir. They are shedding crocodile tears on human rights violations perpetrated by their forces at their behest and they are at present making this drama to woo people here for favor in so called elections. While as India continues with its policy of repression in a bid to curb and suppress the popular sentiment of freedom. People of Kashmir are well aware that India has forcibly and illegally occupied Kashmir against their wishes and aspirations through military might and has unleashed terror, bleeding and destroying Kashmir to strengthen its hold but Kashmiri people are strongly determined to continue the ongoing freedom movement despite all odds till it reaches its logical conclusion and will never allow the supreme sacrifices go waste. Mr.Naqash paid glowing tributes to three youth who were martyred by Indian forces during 2010 peaceful pro freedom mass movement and said that the supreme and innumerable sacrifices given by people of Kashmir regardless of age and gender will realize our freedom.

On 28 June 2013, Salman Khursheed, India’s External Affairs Minister, on a visit to Srinagar, said about the Kunan Poshpora mass rape/torture case that, “I am ashamed that it happened in my country”. Further, he said that in war there is suffering. But, post war, there must be forgiveness. Finally, he stated helplessness in dealing with the situation.

It took 22 years for someone in the Indian Government to partially acknowledge the Kunan Poshpora mass rape. It is obviously not enough. Justice cannot be substituted by mere acknowledgements. Prosecution of 125 accused Rajputana Rifles personnel is the only meaningful response required. Anything else, including the present lip service, will be construed as sustained impunity for the perpetrators. We do not need their acknowledgements. We know the very long list of criminal acts of the Indian troops in Jammu and Kashmir and we understand what it means when the State was silent and provided impunity for so many years. It is the struggle for justice that makes lies unsustainable and therefore truth comes out. We need justice and these statements after decades of lies and denial of justice do not impress us. Reconciliation minus justice is unacceptable.

Salman Khursheed, as the External Affairs Minister of India would be aware of the international connotations of his statement in which he appears to accept that the Indian State is at war with the people of Jammu and Kashmir. Consequently, international law including the rules of war must apply to the Indian State and its role in the commission of gross human rights violations. India is party to the Geneva Conventions, 1949, and the Genocide Convention, 1948. India’s role in Jammu and Kashmir must be considered in light of the laws relating to Genocide, Crimes against Humanity, War Crimes and numerous other internationally recognized crimes.

Further, by accepting helplessness in dealing with the situation, the Indian External Affairs Minister makes a strong argument for Indian State institutions to step aside and immediately allow Jammu and Kashmir to be brought to the attention of international law and institutions. In April this year, various human rights groups from India, Nagaland and Jammu and Kashmir while acknowledging the scale of human rights violations and the denial of justice, sought that a United Nations monitoring group be created to be based in Jammu and Kashmir, to monitor and report on the past and ongoing human rights violations in Jammu and Kashmir.

After the partial acknowledgement by the Indian External Affairs Minister, the Indian army now is in the dock. They should end the era of obfuscation and refusal to cooperate with the processes of justice.

Dear Sir,

It is the first time ever rape victims of Kunan Pushpora had an admission of penitence from a leader of your stature and the nation of Kashmir is moved.   This related to the incident in 1991 that shook all India and abroad and a large protest demonstration to the parliament was led by Mufti Baha-ud-din  ex Chief justice of Kashmir.  While people were waiting for justice to be served on perpetrators, there were a series of repeated gang rapes, massacres, target killings, fake encounters and enforced disappearances filling unmarked graves.   The figures are alarming and are all on official record.  The Japanese apologized to Chinese for the gang rape and massacres in Nanking in occupation a century back, but the wounds had healed when the city was restored. 

Sir, you mentioned Nelson Mandela and his forgiveness through Truth and reconciliation Commission that was set up by him as President of South Africa free from apartheid.   A million families in Kashmir have suffered bereavement: How many could we make amends with?  At what point could we say to them that no more punishments will be inflicting on you?   It is commendable that you made a parallel with a war like situation in Kashmir in which ordinary people were marauded and killed.   People are at the receiving end because they can be cajoled, manipulated, agitated and stirred to face harsh treatment to serve vested interests. 

Sir, you are right in saying that Indian army did not come to Kashmir on their own.    People in Kashmir received them with open arms in 1947 and accommodated all ranks of officers in their own homes.   They were here to liberate people from outside incursions like any benevolent Chapter 7 operation in this category.   At some stage later on the same forces changed their role and people had little choice but suffer.  The fact AFSPA has been debated is simply to mitigate that suffering.     In defending protection of forces that are guarding borders however they may not use AFSPA out there.  Their own laws from military manual are robust. 

Sir, you have made a reference to some formalities in regard to a solution.  People simply aspire for clarity in their relationship with Indian Union in the face of the enormity of imperatives and harsh laws that govern them.   The fact that India cannot understand problems facing the people and not even to know who to have talks with, then a simple impartial referendum must be held to make their choices and concerns clear.   The absolute confusion expressed must be cleared as you rightly say and it is ultimately the people who have to assemble their thoughts and make concrete proposals.   There are some basics people have not reconciled with that will come up in their deliberations like their historical tile and status in 1947 and fragmentation of their home that parted Pakistan Administered Kashmir and Aksai Chin.   A debate on all treaties and agreements that have impacted their foreign policy relationship is felt as organic substantive issues that will bring clarity on their demands and problems.   The total damages suffered by people summed up so far will be so colossal that they will stand well apart from Telangana or Uttrakhand in comparison.    Local governance is difficult.   All laws introduced to streamline administration become peremptory because there is no love lost between the governing structures and the governed.  The result is chaos, corruption and retrogression in development.   Time is not on their side, and a simple comparison with another former princely state Hyderabad is a stunning revelation.   The progress, infrastructure, skyline and level of lifestyle profiles in Kashmir are no match.  Notwithstanding Kashmir was a richer state in 1947.

Sir compassionate understanding and the helping attitude of all recent dignitaries visiting Kashmir brings a new hope for the growing generation and it will be a universal panacea if serious deliberations were initiated at highest levels with people groups and not be swayed by some make belief political parties who have no interest in a resolution and have very little realistic support in public.   Bilateralism negotiations held in Delhi, Karachi, Agra, Bhutan, Lahore and many other places surfaced more diatribe and differences than common ground for a solution of Kashmir.  That may be on more reason why an aura of confusion confounds relationships in Kashmir and there is despondency that an end is not in sight.    A humble plea from the youth born in this conflict is to please give them a future.

Azad Kashmir is an area which comprises 4200 square miles which was liberated through the combined efforts of the Kashmiris Pathan (Mujahideen), and the Pakistan Army. The whole state of Jammu and Kashmir could have been liberated but unfortunately, Sheikh Abdullah succumbed to the nationalist views of Pandit Jawaharlal Nehru and divided the nation. As a result the Indian state occupied 42000 square miles of Jammu and Kashmir and enslaved 12 million of its inhabitants. In order to break the will of Pakistan for the liberation of Maqbooza Kashmir, India is once again spreading nationalist sentiments in Azad Kashmir. Many individuals are buying into this propaganda are motivated by their own self-interest such as refugee status claims which can be legitimized if they propagate such a stance. These individuals are shameless and are ultimately weakening the liberation movement of Maqbooza Kashmir. These so called nationalists have stooped so low, and without any intelligible contributions to the liberation movement are creating 15-20 fake IDs per person on social media websites such as Facebook in order spread misinformation. For instance, Dr. Shabir Chaudhry is operating by a host of different names such as Jammu Kashmir, Arngier Wybjorn, Tara Khan, Khalil Qaisar Gill. While many individuals are busy with genuine efforts for the liberation of the Kashmiri people by sacrificing their time and efforts through means such as protesting against the recent arrival of the Prime Minister of India; these self-interested individuals do not even have one statement regarding the situation discussing the realities on the ground including the grave atrocities being committed. What makes this impartiality to the truth even worst is that not one day goes by when one of our own does not suffer grave atrocities at the hands of the Indian occupier. In order to secede, nationalists require at least 51% of the population to push for a sovereign state. This clearly does not represent the reality on the ground, the people of Maqbooza Kashmir would never let it happen, and, is merely a selfish pipedream. It is unimaginable in what manner these individuals who seek to destroy the unity of a Muslim state would answer those that have sacrificed themselves for the very people who are selfishly pushing a nationalist agenda.

It is worth noting that the people of Kashmir are widely dispersed and play active roles within Pakistani society. Countless individuals from Kashmir, whether that be Dr.Alama Mohammad Iqbal, Qudratullah Shahab, Ghulam Mohammed Gama Pehalwan the renowned wrestler, Yusuf Buch a senior civil officer, to the current Head of State in Pakistan Nawaz Sharif are natives of Kashmir. Nationalist in Azad Kashmir claiming “so called oppression and enslavement” have absolutely no basis. Kashmiris are the natural citizens of Pakistan and have made countless contributions to what Pakistan is today. Equating Azad Kashmir to Maqbooza Kashmir is simply a strategic move being utilized by nationalists of Azad Kashmir in order give credibility to their outlandish claims. However, the stark reality is that these individuals are nothing short of thankless; thankless to those who are and have already sacrificed themselves while they propagate nonsense behind computer screens. Over 200,000 civilians have died in Maqbooza Kashmir at the hands of the Indian occupier. Muslims hold a marginalized position in Indian society at large and especially in Maqbooza Kashmir where they are institutionally oppressed. As such, we must be very careful of making black and white distinctions. We must make logical and factual based decisions on who is the oppressor, and who is the liberator.

The push by Azad Kashmiri nationalists can be humorously equated to all those who have already been wed at the time when their close friend or relative is being wed. When the already wed individual notices that his friend is receiving a lot of attention and holds the position of “the man of the hour”; they do desire to receive this same attention and hold a position of being the “centre of attention”. Jokingly, we can equate this scenario to nationalists in Azad Kashmir. Despite being liberated, free of oppression and having had thousands sacrifice their lives for their freedom and equality; they claim to be oppressed and equate their situation to those of Maqbooza Kashmir. This does nothing but delegitimize the cause of those who are actually occupied and enslaved in Maqbooza Kashmir.

It is essential to realize that less than one percent of Azad Kashmiris support the nationalist rhetoric that is currently being propagated. This overwhelming minority are nationalists (a term which is alien to Islam) who would seek to destroy the unity of the Muslims by dividing them. However, the one percent does not hold the legitimacy to represent the rest of the populace especially when their view is in complete contradiction to the views of the remaining 99%. Let me make it clear for you in unpretentious terms; the whole state of Jammu and Kashmir and its inhabitants are both the territory and the citizens of Islamic Republic of Pakistan respectively whether you like it or not.

The mercy to mankind and the last Prophet Mohammed (Peace Be Upon Him) clearly stated in a Hadith narrated by Anas (May Allah be Pleased With Him) “Help your brother, whether he is an oppressor or he is an oppressed one. People asked, ‘O Allah’s Apostle! It is all right to help him if he is oppressed, but how should we help him if he is an oppressor?’ The Prophet said, “By preventing him from oppressing others.” Sahih Bukhari: Volume 3, Book 43, Number 624. The command of our beloved Prophet Mohammed is quite clear here. He has clearly asserted the importance of helping both the oppressor, but more importantly, the oppressed. This help should be extended to all, regardless of faith as we are all a part of the human family through knowing what one is witnessing is wrong in one’s heart, speaking out against the oppression, or using physical means when necessary. But undoubtedly, an even stronger bond is prevalent amongst those which bring faith on the message of Prophet Mohammed (Peace Be Upon Him) and are the followers of Islam as we are all brothers and sisters, one to another. Should we let pre-Islamic conceptions of ignorance such as caste, colour, creed, nationality, linguistic orientations deter us from helping our Muslim brothers? The fact is that regardless of where you live, if you are not Kashmiri, than you are a Muslim, and if not that, you are at least human beings. As part of the human family, it is our moral and ethical obligation to speak out for those who are being oppressed. As such, remembering that the truth is always on the side of the oppressed, all individuals of the human family, especially of Islamic faith must band together and stand up for the liberation of Maqbooza Kashmir.

I would also like to take this opportunity to thank all those who have joined me in my struggle to disseminate factual based knowledge regarding the Kashmiri issue. This effort that we are all putting forth, unlike the recent and rare nationalist sentiments that have been forming are clearly and wholeheartedly for all of our Muslim brothers and sisters of Maqbooza Kashmir. We have no vested self-interest or material gain to be attained from the liberation of Maqbooza Kashmir; just the satisfaction and peace of mind for the people of Maqbooza Kashmiri after decades of oppression. May Allah (SWT) The Almighty help us all in our clean and pure intentions and May He Bless the people of Maqbooza Kashmir with freedom.

Chairman Islamic Political Party Maqbooza Jammu and Kashmir Mr.Mohammad Yousuf Naqash has
supported the strike call given by pro freedom parties against the Kashmir visit of Indian Colonial ruler Mr. Manmohan Singh on 25th June and urged people to lodge strong protest against him and occupation government of India on this date to send a strong message that Indian government and its head is not welcome in Kashmir but against the wishes and aspiration of the people and also vindicate the  principled stand of Kashmir clearly to the world that People of Maqbooza Kashmir stand and struggle for only freedom, not for materialistic benefits  and developmental works, which can be addressed with the natural and other resources of Kashmir. Actually Indian government is looting our resources for its own benefit.  Maqbooza Kashmir is the issue of the freedom from Indian illegal and forced occupation and this present Indian forced and illegal occupation of Kashmir is neither tolerable nor acceptable to the people of Kashmir who are strongly determined to continue their ongoing struggle to get rid of Indian occupation at any cost. He further said that Indian occupation of Kashmir is a human tragedy and India after forcible and illegal occupation of Kashmir in 1947 has converted it in to most dangerous and unsafe zone in the world through its more than seven hundred thousand (seven lakh) heavily armed forces in a bid to suppress and crush the inherent right of freedom. People regardless of age and gender are daily butchered, arrested, tortured and imprisoned by Indian forces. The chastity of our women folk is violated. Let me clarify something for you. There are those who possess absolutely no factual information, and as such, all they can do is appeal to emotions and derogatory language. On the other hand, there are those who are guided by facts and knowledge. It is quite clear which category you fall into. Please do not fool yourself into believing that you represent either Azad Kashmir or in Maqbooza Kashmir. By in far you fall into a very small minority which has succumbed to the nationalist propaganda originally disseminated by India.

There are only two outcomes to a war; either you win or you lose. Pakistan lost the war to India in 1971, and therefore, Bangladesh, formerly East Pakistan became its own state. You are living a life of freedom and equality in the 4200 square miles of Azad Kashmir without any fear from state repression, or institutional subordination talking nonsense behind a computer screen. While you talk behind a screen, others in Azad Kashmir, Pakistan and Maqbooza Kashmir are fighting and dying for the freedom of the latter and its rightful accession to Pakistan. Individuals such as you are contributing nothing for the liberation of Maqbooza Kashmir. Instead, nationalist’s claims from Azad Kashmir are serving to both delegitimize and have become an impediment to the freedom of Maqbooza Kashmir. The Kashmiri liberation movement does not need individuals such as yourself who are far removed from reality and have no sense of the power structure of the international system. As far as Mr. Azmat A. Khan is concerned, he is among the overwhelming minority which shamelessly falls into the category of individuals who would like to stay with India despite the open discrimination, massacre, and dishonoring of women by the Indian state.

The state of Jammu and Kashmir is not only a Muslim majority area but it also bears geographic contiguity as the vast majority of its territory is in line with the Pakistani state. These two criteria’s were the basis for the division of the sub-continent. Azad Kashmir, a territory of 4200 square miles has been liberated from the Indian occupation and is already a part of Pakistan. The remaining 42,000 square miles along with its 12 million inhabitants are still to be liberated and will also become Pakistani citizens. The Kashmir Diaspora Alliance, the organization I represent will not fall into the propaganda of the Indian state and dissuade our Muslim brothers in Azad Kashmir. The people of Maqbooza Kashmir want to see Pakistan strong as it is the only actor which can liberate us from the Indian occupation, Allah (SWT) willing. We are certain that the time is not far when we shall be able to eject every single Indian armored and civil personnel and be free of Indian occupation. The fact is, you should not only be ashamed of yourself, but the claims you make are misinformed. 200,000 people have died in Maqbooza Kashmir in over six decades while the citizens of Azad Kashmir and its people enjoy freedom and equality. Freedom and equality do not come for free. The Pakistani people, encompassing the people of Azad Kashmir have fought and died for it. So while you sit safely behind a computer screen, and propagate nonsense, you should know that people have and are dying and sacrificing themselves for the Kashmiri cause. I repeat the dominant consensus which is held by the people of both Azad Kashmir and Maqbooza Kashmir a long with international law is that; Azad Kashmir is the sixth province of Pakistan and its inhabitants are the bona fide citizens of Pakistan. With the Pakistani efforts pushing for plebiscite for Maqbooza Kashmir, it will too soon accede to Pakistan, whether you like it or not.

First of all I apologize for the delay in responding to your comments wherein you noted that, “If Muslim Umma should be one nation, why not start from the centre of Islam and then annex other Islamic nations into one great Muslim nation. Kashmir has been annexed by force by Pakistan and by deceit by India, so they both must leave us alone. To be one's own master is no crime or blasphemy .We deserve to be our own masters because we have suffered for centuries. The Pathans, the Mughals, the Sikhs and the Dogras have given us slavery and plunder. So we deserve to set up out own nation. The ground reality still persists or the players have changed. So Mr. Yousafzai, rethink your opinion. God Bless."

I would like to assert that you are already well aware that Muslims came to India comprising a fraction of the population and united and ruled the subcontinent for over a thousand years. However, I will not give you a history lesson. The fact is, under Muslim leadership, the Kashmiri’s lived as a free and prosperous people. Under Indian occupation, they are truly slaves. But this is besides the fact, and, of all this you are already aware. Yet, you have chosen to ignore this in order to propagate misinformation from a nationalist stance. It is Pakistan that is fighting for the right to self-determination/ plebiscite for the Kashmiri people, NOT India. It is Pakistan which liberated 4200 square miles from India after it had massacred 100,000 people in Jammu, NOT India. It is Pakistan which is pushing for the right of self-determination for the Kashmiri people, while India has killed upwards of 200,000 innocent civilians until today. Also, with regards to the claim of a “Kashmiri nation”, deserve has nothing to do with this. There are no individuals of a different religious orientation fighting for the freedom of Maqbooza Kashmir. Name one Hindu leader which is pushing for the freedom of Kashmir from India. It is strictly Muslims which are fighting for the Kashmiri cause, so despite wishful thinking, this is strictly a religious issue and nationalism or “secularism” has no part in it. So not only are your claims misinformed and historically inaccurate, but I would like to remind you that things are not black and white and as you have compared Pakistan with India in relation to the Kashmiri issue you obviously need to acquire a lot of knowledge in tune with reality. The bottom line is that the liberation movement’s primary goal is for the Kashmiri people to be able to practice their right of plebiscite as per the UN Resolution of 1948. Pakistan is vehemently facilitating the process, while India is serving as a fundamental impediment. May Allah (SWT) bless you and your entire family.

Continuing with policies which have practiced historically in Azad Kashmir in the past by the Pakistani government are of no value. There is no value in having a state within a state. Azad Kashmir is already not only the legal territory of Pakistan, but it is an integral part of the state and is well integrated into the functions of the state. The onus is on the Indian government which is serving as barrier to the people of Maqbooza Kashmir to practice their right of self-determination. As such, the liberation movement should look to freeing Maqbooza Kashmir from the grips of the Indian occupier. This is the fundamental goal at hand.

Hurriyat Conference Chairman Quaid -e-Inqlab Janab Syed Ali Shah Geelani Sahib on Thursday called for a general strike on June 25 when Prime Minister Manmohan Singh arrived in Maqbooza Jammu and Kashmir to press for the “right to self- determination “for the people of the state. “I appeal to the people of the state to observe a complete general strike on the day the Prime Minister arrives here”, he told reporters at his residence here. He said the strike will be observed to remind Government of India and the world that Kashmir is a dispute pending a resolution. "Besides, we also want to press for our demand for return of mortal remains of Shaheed Mohammad Afzal Guru and Shaheed Mohammad Maqbool  Bhat to their legal heirs for burial according to Islamic rites," he said. The Prime Minister is scheduled to visit the state on June 25 to inaugurate the Qazigund-Banihal link of the Kashmir rail project. On reports of threat to Amarnath Yatra, Janab Geelani Sahib said the government's claim of threat to the Yatra was apolitical stunt aimed at maligning the freedom struggle of Kashmiris.

The inhabitants of Gilgit Baltistan unequivocally accepted the advice of the Muslim League and joined Pakistan in 1947 and have just recently become its fifth province. Although there was some initial resistance from the Indian government, in the end they succeeded in their rightful and willing accession to Pakistan because they were unified. The people of this area staunchly asserted and continue to assert today that they are not Kashmiris. Rather, the people of Gilgit Baltistan first identify themselves as Muslims and then as the citizens of Pakistan. The territory of Gilgit Baltistan has no affiliation with the “disputed territory” of Azad Kashmir or Maqbooza Kashmir. In their strategic efforts to make a claim of “secularism” or a separate state, a few nationalists vying for their own self-interest are attempting to give legitimacy to their morally bankrupt stance for an autonomous and separate state in Azad Kashmir. They are doing this by attempting to attach their claims on Gilgit Baltistan. Not only do they have no basis for a separate Kashmiri state which was liberated by the Pakistani government; they are now attempting to bandwagon Gilgit Baltistan to their illegitimate cause. We must realize that the territorial designation of Jammu and Kashmir as per the borders outlined in August 14, 1947 only holds relevance to its accession to Pakistan on the basis of religion, the fundamental logic behind the two nation’s theory and the division of the Indian subcontinent. This has no relevance to Gilgit Baltistan which willfully, by choice, acceded to Pakistan due to its Muslim majority. Gilgit Baltistan may have been a part of Jammu Kashmir centuries ago, but so were many states of Central Asia. As such, Gilgit Baltistan has no relevance to the issue of Maqbooza Kashmir under the occupation of the Indian government, and is even further removed from the morally bankrupt claim of a “sovereign Azad Kashmir.”    

The nationalist logic was originally strategically initiated by Pundit Jawaharlal Nehru who successfully played the nationalist card and was able to indoctrinate Sheikh Abdullah as to prevent Jammu and Kashmir’s accession to Pakistan. As a result, the Indian government with the help of Hari Singh massacred more than 100,000 Muslims from the Jammu region and more than two million innocent civilians were forced to leave the territory and sought refuge in Pakistan in the third week of August in 1947. Shockingly, the atrocities by the Indian government continue until today with over 200,000 civilian deaths in Maqbooza Kashmir. Due to Sheikh Abdullah’s shortsightedness, India was disseminate the logic of nationalism, yet simultaneously occupied 42,000 square miles of the State of Jammu and Kashmir. Pakistan liberated 4,200 square miles of the area which is now known as Azad Kashmir. Subsequently, it fought another two wars to regain the remaining territory and free the citizens of Kashmir from the institutional subordination and slavery of the Indian government.

In an ironic fashion, the occupier through the Indian head of state Pandit Jawaharlal Nehru approached the United Nations which passed a resolution to give the right of plebiscite to the people of Kashmir. In hypocritical fashion, there was no mention of illegally occupied Hyderabad, Junagar, and Manawa. It is essential to understand that the fundamental contradiction here is that India’s occupation of Pakistani territory actually made it a “legitimate” party instead of being reprimanded for its interference in the Muslim majority state. This is comparable to a scenario in which one can illegally occupy someone’s home and then demand that each individual be questioned as to whether they would like to side with the occupier or their prior rightful owner. Furthermore, despite approaching the UN over six decades ago, India remains the fundamental impediment to the Kashmiri peoples’ right of plebiscite.

The people of Azad Kashmir must root out and stop the propagation by nationalists which seek to make the same mistake which Sheikh Abdullah made over six decades ago. These nationalists are delegitimizing the cause of Maqbooza Kashmir and inadvertently or intentionally serving the cause of the New Delhi Administration. Pakistan is fully aware of these tactics and will not back away from its original claim over Maqbooza Kashmir and its people’s accession to Pakistan. We must realize that there is no legitimate claim or precedence available wherein sovereignty has been attained on the basis of secularism. Recently East Timor and South Sudan used their right of self-determination on the basis of their religious difference because both territories were Christian majorities. They did not want to live with the Muslim majority. Through asserting secularism as the cause for sovereignty, the overwhelming minority of nationalists in Azad Kashmir are delegitimizing the original, rightful, and applicable claim for Maqbooza Kashmir’s accession to Pakistan on the basis of religion outlined in the two nation theory.

Today, on 18^th June 2013, the Judicial Magistrate Kupwara J. A. Geelani, while dismissing the conclusions made by the police in the recently filed closure report in the case of Kunan Poshpora mass rape of 23-24 February 1991 returned the case file to the police, asking for “further investigation to unravel the identity of those who happen to be perpetrators”.

As the demand by us and the survivors was for the re-investigation by Special Investigation Team (SIT), headed by an officer of Senior Superintendent of Police (SSP) rank, the court while mentioning the lack of authority in ordering SIT, asked the further investigation to be conducted by an officer not below the rank of SSP and within a time bound period of 3 months.

On 10 June 2013, a protest petition was filed by Adv. Parvez Imroz on behalf of the survivors of Kunan Poshpora mass rape against the closure report of the Jammu and Kashmir Police, before the Judicial Magistrate, Kupwara. On 13 June 2013, the Chief Prosecuting Officer [CPO] filed objections, and today, oral arguments were made before the Magistrate.

The protest petition argued that the police investigations were incomplete and clearly mala fide as despite having the information on file regarding the involvement of 125 personnel of 4^th Rajputana Rifles, the police had not questioned them and neither was an identification parade conducted. The Judicial Magistrate Kupwara while acknowledging the submissions made by us has mentioned in the judgment that, “Until date the investigating agency has not unveiled the identity of the culprits despite having a clear cut nominal role of 125 suspects”

The response of the State, through the CPO Aashiq Hussain was unsurprisingly bad in law, and deeply disrespectful of the victims of Kunan Poshpora. First, they argued that there was no right of filing a protest petition, a position unmindful of the law. Second, the State argued that the protest petition was being filed to allow other victims to get cash compensation, and that the victims appeared to have woken up after 22 years and the protest petition was barred by laches. While rejecting the submissions of the CPO, the Judicial Magistrate, Kupwara upheld the right to file the protest petition and further observed that, “The instant final report ought to have been forwarded to the Magistrate way back on 12^th October 1991.”

After 22 years of cover-ups and delay, the State conveniently blocked the High Court PIL and now was shamelessly attempting to block the victims’ remedies before the Judicial Magistrate. Instead of taking the responsibility for delay and denial of justice, the State has chosen to malign the victims and choke any remedies for the survivors of Kunan Poshpora.

Today’s order is an achievement of the struggle of the Kunan Poshpora people along with those who supported their demand for justice. This will surely inspire many more victims of the recent past to wake up and fight for justice in their cases.

We reiterate our commitment that we will continue the struggle till justice is done. Now the Government should comply with the orders of the court and give up their reluctance of punishing the guilty.

He recently died on June 15, 2013 in Mirpur Azad Kashmir, Pakistan. Our prayers are with him and his family. May Allah (SWT) forgive all of his sins and give him safe passage to heaven without judgment. We also pray that Allah Almighty give his family forbearance and patience in these testing times. The unprecedented supreme and innumerable sacrifices and ongoing perpetual struggle will soon usher in realizing our mission freedom and Indian unabated repression and conspiracies can neither deter nor stop us from achieving freedom as our people are determined to continue the resistance and move forward in pursuit of mission freedom which our great martyrs are cherishing with their sacred blood and it is our resolve to preserve and promote their mission and not allow to go them waste. Mr.Naqash paid glowing tributes to all the martyrs of Kashmir freedom struggle and strongly condemned continuous house arrest of prominent pro freedom leader and Chairman All Parties Hurriyat Conference Janab Quaid-e- Inqlab  Syed Ali Shah Gilani Sahib. Mr.Naqash appealed international community including United Nations Organization, O I C shoulder their responsibilities for restoring freedom to Kashmir in accordance with the United Nations charter on the principle of right to self determinations and stopping Indian repression on Maqbooza Kashmir.
